1.   Contractor guarantees all work to be free of defects in material and workmanship for a period of two (2) years from date of Substantial Completion when subject to normal use and care and shall, upon written notice within those years, remedy any breach without charge, provided Owner has complied in full with terms and payment in full of this contract. Substantial Completion is when pool is filled with water.

2.   Contractor further guarantees that the structure will remain structurally sound for the lifetime of the pool. The term “Lifetime of the pool” shall be construed to mean the period that the pool is owned by the original purchaser.

3.   The term “Structurally Sound” implies that the swimming pool is capable of holding water and in the event of a failure to do so Contractor will within said period repair the same so that it does hold water.

4.   The Lifetime Structural Guarantee does not extend to or cover items external to the pool, such as tile, coloring, plaster, electricity, filter, heaters, decking or pool accessories. Plaster is not guaranteed against discoloration or staining inasmuch as this is common due to the local water, wrong use of chemicals or lack of cleaning. The Lifetime Structural Guarantee is invalid should any of the following occur: (a) pool not kept full except for a ten (10) day period each year for maintenance; (b) should the water table be above the lowest point of the pool; (c) should the structure be damaged by earthquake, war, earth or earth fill movement, or by disasters not occasioned by the contractor, such as explosions, wrecking or the like; or (d) should there be a transfer or change of ownership in the subject property.

5.   All items of pool equipment as provided in this contract carry a minimum one year guarantee and for certain items, as shown on brochures, an extended guarantee against defects in workmanship or materials, as provided by the manufacturer.

6.   Defects or failures caused by obvious mistreatment or neglect shall be repaired or serviced at Owner’s expense. All warranties or guarantees connected with this contract shall be void, if during the life of said contract, any other swimming pool contractor or service company does work on the swimming pool equipment.

7.   Walks and decks are not part of the pool and Owner understands that there is no warranty covering same regarding cracking, checking, raising, settling or discoloration.

8.   Terms and provisions of this guarantee are not effective until final payment of contract is received.

Sidewinder Custom Pools uses Jandy products wherever possible.  Jandy offers us both a three-year parts and labor guarantee and a one year parts and labor guarantee with a three year extended service agreement which can be purchased to cover your investment for a total of 4 years.

The remaining items on the pool carry a 2-year guarantee per the Arizona Registrar of Contractors guidelines.
